PT Cerdas Digital Nusantara (โ€œCakapโ€, โ€œWeโ€) offers you (โ€œReferrerโ€) to take part in our referral program (the โ€œProgramโ€) We reserve the right to terminate or amend the program at any time for any reason. This Program is administered by Cakap which may outsource certain elements of administration to third parties (collectively โ€œAdministratorโ€).

Referrers are bound by these Terms and Conditions. By participating in the Program, Referrers agree to use the Program in the manner specified in these Terms and Conditions. If you do not agree to these Terms and Conditions in their entirety, you are not authorized to register as a Referrer or to participate in the Program in any other manner. Referrers may not participate in the Program where doing so would be prohibited by any applicable law or regulations.

Agreeing to the Cakap registration Terms and Conditions means agreeing to the Program Terms and Conditions, which have become the Cakap Terms and Conditions.

Cakap has the sole right to determine the validity of a Referrerโ€™s user account. On top of that, Referrer must:

  1. Be an Indonesian citizen.
  2. Be at least 18 years old.
  3. Have a valid and existing account of Cakap.
  4. Comply with the Terms and Conditions determined by the Cakap party in relation to the Referral Mechanism of the Program.
  1. The Referrer is a party registered on the Cakap platform with the terms and conditions as stated in the Referrerโ€™s Eligibility.
  2. Once the conditions in point 1 are met and the Referrer is declared registered on the Cakap platform, the Referrer may access the Program on the Cakap application, spesifically in the Referral Program feature.
  3. Referrers are required to follow the on-screen instructions and will be provided with a personal reference code that can be shared with friends, family members, and colleagues ("Referred Users").
  4. After sharing the referral code, the Referred User will be given a link to open or download the Cakap application.
  5. ย Referred Users will be redirected to the Program orientation screen and Cakap Private.
  6. Referred users will be directed to select a package based on their needs and apply the referral code on the payment screen. Referred Users can receive a 25% discount on the Cakap Private package.
  7. ย As for the Terms and conditions contained in the reference that meets the requirements below.
  8. Once payment has been made by the Referred User and the status has changed to "Paid", the Referrer will receive the reward as stated in the About Rewards points.

  1. A new user who has never registered on Cakap Platform, including but not limited to purchasing a placement test.
  2. Not a Referrer's referral code.
  3. This program is valid if the package chosen is Cakap Private and not a purchase of other Cakap products.
  4. If the Referred Users have used the referral code in one of the language studies, then the person concerned can still use a different referral code for other language studies.
  5. The referral code can only be used 1 (one) time per user.
  6. If the Referred Users concerned have purchased other Cakap products but not included in the Private Cakap package, they still have the opportunity to get referral discounts.

  1. The commission earned is 10% of the total purchases of Referred Users.
  2. The nominal amount of the commission as referred to in point 1 (one), may be in the form of rounding the nominal up or down. This is the full right and/or authority of Cakap.
  3. The percentage and/or the maximum amount of commission and reward may change at any time without notice and are fully under the authority of Cakap.
  4. Commission only applies to the Cakap Private packages, in any language/study.
  5. Commission applies in multiples of the number of friends who have successfully joined the Cakap platform.
  6. The Referrer will get a commission in the form of a merchant voucher and it can be broken down and/or divided into several parts whose fraction is equivalent to the total reward (example: Rp1,000,000,- (One Million Rupiah) = 10 (ten) vouchers, of which 1 (one) Voucher worth Rp100,000, - (one hundred thousand Rupiah).
  7. Merchant vouchers are the full right of the Cakap Party according to availability and adjustments by third parties. Vouchers that already have been assigned once will not change.

  1. After the Referred Users make a purchase, the voucher status will be "Pending". This applies until Cakap assigns a commission to the Referrers.
  2. Referrers will get rewards when the Referred Users successfully purchase a Package.
  3. The provisions as stipulated in point 2 (two) if the purchase status of the Referred Users must be โ€œPaidโ€.
  4. The distribution of the voucher will be valid at the beginning of the month and the calculation of the amount and/or the amount of the commission is valid in the previous month. Maximum on the 10th at the beginning of the month.
  5. As for the ways to use vouchers, it can be different for each merchant and for the ways and/or steps for the โ€œredeemโ€ process, it can be seen on voucher details screen.
  6. Every voucher has an expiry date. Referrers can only use and apply the voucher within the specified duration and/or period and after the expiration date or expiry date, Referrers will not be able to use the voucher including but not limited to attempts to โ€œrequest extendโ€.
  7. The validity period of the voucher depends on the policy of each merchant.
  8. Rewards/commissions may at any time be not given or canceled unilaterally if based on observations from Cakap there is a real fraud in this mechanism.
  9. The reward/commission used is in the form of a voucher which is distributed on a link and/or code.
  10. Rewards have no monetary value and cannot be exchanged for cash. Rewards are non-transferable and cannot be auctioned, traded, bartered, or sold. Upon termination of the Program or any part thereof for any reason, any unredeemed rewards that have not been delivered to the Referrers will be forfeited or become invalid.

Cakap aims to create a good, conducive, and positive online foreign language learning community. Therefore, we have formulated terms and conditions to govern the use of the services offered by PT Cerdas Digital Nusantara in relation to the use of the website www.cakap.com and the Cakap application. Users are required to carefully read and understand the established rules, as they affect the rights and obligations of users based on the laws applicable in the territory of the Republic of Indonesia.

Cakap reserves the right and authority to continuously modify and update these Terms of Service from time to time to foster self-improvement and adapt to technological and temporal developments.

By agreeing to, registering, and/or using the website www.cakap.com and the Cakap Mobile Apps, users are considered to have read, understood, and agreed to all the contents of the stipulated terms and conditions. If a user does not agree to any, some, or all of the contents of the terms and conditions, they are not allowed to use the services on www.cakap.com or the Cakap Mobile Apps.

These Terms and Conditions (as amended from time to time) constitute the entire agreement between the user and Cakap regarding the use of this website or other Cakap websites or servers, replacing any prior arrangements, agreements, undertakings, or proposals, whether written or oral, between the user and Cakap concerning these matters. Cakap reserves the right to update these Terms and Conditions from time to time. In such a case, the updated version will be effective immediately upon being uploaded to this website. No other variations of these Terms and Conditions shall be valid unless they are in writing and signed by an authorized representative on behalf of Cakap. These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of Indonesia, and users agree, for the benefit of Cakap, to submit to the exclusive jurisdiction of the courts of the Republic of Indonesia. If any provisions of these Terms and Conditions are deemed invalid or unenforceable by a competent court, such provisions shall be interpreted, as closely as possible, to reflect the intentions of the parties, and all other provisions shall remain in full force and effect. Cakap’s failure to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision unless acknowledged and agreed upon by Cakap in writing. Unless explicitly stated, nothing in these Terms and Conditions shall create any rights or benefits for anyone other than the user, Cakap, and its affiliated companies.

  1. Cakap is a two-way learning online platform that connects users and video call-based teachers.
  2. Private classes are two-way learning classes between 1 (one) teacher and 1 (one) User person within the Cakap platform or alternative platform selected by Cakap.
  3. Semi-Private and Corporate Classes are two-way learning classes between 1 (one) teacher and 2 (two) or more Users within the Cakap platform or alternative platform selected by Cakap.
  4. Club classes are two-way learning classes between 1 (one) teacher and 1 (one) to 100 (one hundred) users within the Cakap platform or alternative platform selected by Cakap.
  5. Confidential information means any data or information that is the property of the Parties (Users or Cakap Parties) that discloses and is generally unknown to the public, whether in tangible or intangible form, whenever and however disclosed, including and not limited to:
    • Any business and marketing strategies, financial information, or projections, operations, sales estimates, business plans and models, and systems with respect to the Company’s business and performance results relating to the past, present or future activities of such parties, affiliates, subsidiaries and affiliated companies;
    • Plans for products or services, and databases and lists of customers/students/prospective students, clients or suppliers;
    • Any scientific or technical information, curriculum and syllabus of lectures, inventions, processes, procedures, formulas, improvements, technologies or methods;
    • Any concepts, reports, data, science, ongoing work, images, designs, development tools, specifications, computer software, source code, object code, algorithms, flowcharts, databases, inventions, information and trade secrets;
    • Any copyright, trademark, logo, service mark, service name, domain name, literary work, audio visual work, including any other Intellectual Property Rights arising under the applicable laws of the Republic of Indonesia or any country, owned, controlled, stored, held for use, use or developed by and/or for the Company;
    • Any form of screenshots, images, videos and attempts of any kind that can be categorized as dissemination, abuse, deviations committed by students / users / families / affiliates;
    • Any other information that is reasonably considered confidential information from the disclosing party.
  1. Understand basic knowledge in operating Windows, Mac, Android or iOS.
  2. Have a personal computer or smartphone; Recommended laptop or Android/iOS phone.
  3. It has a minimum internet connection of 5 Mbps.
  4. The user is willing to prepare his or her personal image for documentation and certification purposes. Cakap does not have the right to distribute images without the user’s permission.
  5. Minimum age 4 (four) years to be able to take Private classes, Semi-Private and Corporate classes.
  6. Minimum age of 16 (sixteen) years to be able to take Club classes.
  1. Registration can be done by filling out a form on the cakap.com page or in our application. Registration can be done independently or by contacting our Study Advisor who will assist with the registration process.
  2. When you apply for the course, you will also be required to upload certain information, such as name, address, date of birth, profile picture, phone number, verify email, gender, occupation and course purchase needs in Cakap. Any member wishing to apply for one of the courses must meet these requirements and provide correct information that can be supported by legal documents.
  3. The user is responsible for protecting the user’s credentials. The User agrees that it will not disclose the user’s personal credentials to any third party and that the user will be solely responsible for any activities or actions under the user’s Cakap Account, regardless of whether the user has authorized such activity/action or not. Users should immediately inform Cakap about unauthorized use of the user’s Cakap Account.
  1. Users will start subscribing for a maximum of 1×24 hours after making payment. Users can delay the activation of the study package for up to 30 days from the payment agreement.
  2. Cakap only sends invoices through [email protected], Cakap is not responsible for any form of fraud for invoices sent from accounts other than [email protected]. Study Advisor Cakap will also help send payment invoices when explaining payment procedures, as well as during the process of reminding payments for users who have not made payments.
  3. Packages that have been purchased cannot be refunded either in the form of money and/or transferred to another account.
  4. When Study Advisor Cakap contacts prospective users, all phone conversations will be recorded for convenience when transacting.

  2. Payments through GoPay, Tokopedia, Blibli, Shopee, and other digital payments.
  3. Transfer or payment through PayPal Account.
  4. Bank Transfer Virtual Account (BCA and Mandarin)
  1. Cakap’s operational hours are from Monday to Sunday starting from 08:00 to 22:00 (UTC+7). The operational hours of Cakap Study Advisor team on Monday to Friday are from 09:00 to 18:00 (UTC+7) and on Saturday and Sunday are from 08:00 to 17:00 (UTC+7).
  2. Our Student Support & Success will be ready to help users during Cakap’s operational hours.
  1. The total active days in Cakap will be different each month. Users will be notified about holidays through the website page or via email.
  2. Holidays for Chinese classes based on Chinese and Indonesian calendars.
  3. Holidays for English and English for Kids classes based on Filipino and Indonesian calendars.
  4. Holidays for Japanese class based on the Indonesian calendar.
  5. Holidays for Indonesian classes based on the Indonesian calendar.
  6. Holidays for Korean class based on the Indonesian calendar.
  1. Learning packages with credit sessions, are study programs that are divided into 3 categories:

    • Private Class lets the students choose the number of learning sessions that will be taken according to the study package period they have with at least 1 session in 1 day.
    • Semi-private classes are given access to 3 learning sessions in 1 week with a period according to the package purchased or chosen (3 months and 6 months period).
    • Corporate Classes are given learning access in the form of credit sessions according to the number of sessions and study schedules agreed by the Corporation and Cakap.

  2. Learning packages with regular meeting sessions, are packages that only apply to Private classes where this package is divided into 3 types:

    • Brush Up: Study program for 3 months (90 days), 6 months (180 days) or 12 months (360 days) which has a maximum of 1 booking session per day. If the user did not attend the class on the previous day, it cannot be accumulated on the next day.
    • Skill Building: Study program for 3 months (90 days), 6 months (180 days) or 12 months (360 days) which has a maximum of 2 booking sessions per day. If the user did not attend the class on the previous day, it cannot be accumulated on the next day.
    • Intensive: Study program for 3 months (90 days), 6 months (180 days) or 12 months (360 days) which has a maximum of 3 booking sessions per day. If the user did not attend the class on the previous day, it cannot be accumulated on the next day.

  3. Users are suggested to take classes at least 3 to 4 times a week.
  4. Private Class, Semi Private and Corporate class starts at 08:00 (UTC+7) and ends at 22:00 (UTC+7). Regarding the availability of teachers, Cakap will ensure the availability of teachers if they have been ordered by other users.
  5. Our Club Class starts from 08:00 (UTC+7) to 21:00 (UTC+7). Users can join any class that is running.
  6. To maintain the quality of teaching at Cakap, some classes will be recorded and stored on the Cakap server. And the recording becomes the full Rights of Cakap.
  1. Cakap Private Classes for Mandarin, Mandarin for Children, Japanese, Korean and Indonesian will be 45 minutes long while the duration for Private English and English for Kids Classes will be 25 minutes.
  2. Semi Private and Corporate Classes for Chinese, Chinese for Kids, Japanese, Korean, English and English for Kids will be 50 minutes long.
  3. Cakap Club class will be 25 minutes long for the trial class and 50 minutes for the premium class. There is no minimum time limit to be able to attend Club classes but users are suggested to be able to take full Club classes so that the learning materials can be fully accepted.
  4. Cakap’s Private class users who do not attend a maximum of 15 minutes after the class starts will be considered absent.
  5. Semi-Private and Corporate class users who do not attend a maximum 30 minutes after the class starts will be considered absent.
  6. Delay in entering class when class has started will reduce the duration of the learning process that has been determined (in part points 1 and 2).
  7. Our teachers allow a maximum of 5 minutes (for Private classes) and 10 minutes (for Semi Private and Corporate classes) from the time of order so that you can still enjoy the maximum duration of study.
  8. In Cakap Private classes, our teachers will wait up to 15 minutes late from the time of booking so that users can enjoy the rest of the class duration.
  9. And in Semi Private and Corporate classes, our teachers will wait up to 30 minutes late from the time of booking so that users can enjoy the rest of the class duration.
  10. For Club classes, there is no minimum time limit to be able to attend class.
  1. Once students complete certain criteria for level completion (including but not limited to completed teaching hours, materials, exams, and improvement in their speaking skills) students will be awarded their level upgrade and certificate for completion of that particular level.
  2. The level of progress and certification of students at Cakap is entirely Cakap’s right as a learning institution and is given at the discretion of the head teacher/course manager according to internal academic standards.
  1. Cakap users are required to take and complete the mid-exam and final exam to enter the next level.
  2. Cakap users who have not completed the mid-exam or final exam, cannot book a class or advance to the next level.
  3. Mid-exam takes place every mid-material in one semester. Meanwhile, the final exam takes place at the end of the semester.
  4. Sobat Cakap has only one chance to repeat the exam if he/she fails to complete the final exam within 1 week after the exam.
  1. In Private classes, users can choose a teacher and book classes independently based on the calendar in their dashboard. If the user has difficulty choosing a teacher, the user can contact our Student Support & Success to assist you to choose the available teacher that is suitable for the user.
  2. In the Semi Private and Corporate classes, teacher selection and class reservations are carried out by Cakap in accordance with the schedule agreement that has been determined at the beginning of the period.
  3. If the selected teacher is unable to attend class due to illness, time off or other circumstances that do not allow the teacher to attend teaching, then we are responsible for providing a substitute teacher on the schedule that has been booked or rescheduling classes that are not running based on an agreement between Cakap and the user.
  4. Class rescheduling is done by deleting classes that have been previously booked by the Student Support & Success team and will be rescheduled according to the time agreed by the teacher and user. This will not reduce the number of sessions the user has if the user takes a learning package with credit sessions. For users who have the unlimited study package, the study period will be replaced according to the number of classes canceled.
  1. Users who are not present in the reserved class (stated in “Learning Duration and Attendance” points 8 and 9), will be considered absent and there will be no substitute class. And the user’s study period will be reduced by 1 session if the user has an unlimited study package. Please contact our Student Support & Success for more information.
  2. In the event that the user does not attend the Semi Private and Corporate classes, the course will be continued according to the schedule and the missed materials and lessons are the responsibility of the user.
  3. In Private classes, users must book classes with teachers at least 6 hours before the desired class schedule and users are allowed to cancel classes at least 3 hours before the class starts.
  4. For Semi Private and Corporate classes, class reservations are made by Cakap according to the agreed schedule and users are allowed to cancel classes at least 24 hours before the class starts.
  5. There is no limit to the maximum number of class cancellations on the unlimited study package and for the study package with credit sessions, the number of cancellations is half of the total credits held.
  6. Users who have purchased a package but due to vacation reasons, prolonged illness or other reasons that prevent users from participating in the learning process at Cakap can apply for study leave. For Semi Private and Corporate classes, leave applies to all users in 1 group and has been mutually agreed upon. Applications for study leave must be notified to our Student Support & Success at least 3 days in advance.
  7. Users can temporarily deactivate their accounts or take time off by paying Rp. 200,000/leave time for a maximum of 30 days. Contact our Student Support & Success to temporarily deactivate your Cakap account.
  8. Requests for leave and study period adjustments will be processed after the user attaches proof of payment for the leave package to the Student Support & Success team.
  9. When the user wants to reactivate the remaining study period after taking time off, the user can contact our Student Support & Success to reactivate the user account.
  1. If there is a network or hardware problem from the teacher, Cakap is responsible for moving the reserved class time to another time that is appropriate and has been agreed upon by the teacher and user. Cakap users need to report the problem to our Student Support & Success within 3 days after the class is held.
  2. If a network or hardware problem occurs from the user’s side during the class, the class will not be replaced.
Users agree not to, directly or indirectly, divulge or use any student’s Confidential Information with the Company (as long as the information is confidential) without Cakap’s prior written consent.
  1. Users are not allowed to have activities outside the class time with teachers outside the Cakap platform. Cakap is not responsible for all forms of violations committed by Cakap Persons if activities are carried out outside the Cakap Platform.
  2. Users are not allowed to transfer the rest of the lessons to other users or other parties, including but not limited to family.
  3. Each user is only allowed to register 1 account on the platform. Only registered users are allowed to enjoy the benefits of studying at Cakap. We prohibit 1 user account that is used for multiple users and Cakap reserves the right to block the account.
  4. Cakap users are expected to provide a polite, clear, and appropriate response to the current discussion topic. All messages that offend ethnic, religious, racial and other groups of people; contains abusive and hateful speech, sexual inclinations, and regional jargon or dialect is prohibited;
  5. Teachers and Cakap Representatives can and/or are allowed to take firm action when Cakap users perform inappropriate behavior or some uncomfortable actions that can make the class unfavorable.
  6. Teachers and Cakap Representatives can and/or are allowed to take firm action and if necessary take legal steps against all forms of actions and/or words and/or statements that contain contents of violations of applicable decency, moral norms, ethics in Indonesia and distributed directly or indirectly either through electronic media and/or social media in any form and the implementation mechanisms and application of sanctions are subject to the provisions of the legislation in force in Indonesia;
  7. As for the provisions as referred to in Point 5 and Point 6 of these Terms and Conditions, Teachers and Cakap Representatives may provide Firm Action and/or sanctions in the form of:

    • Oral warnings including but not limited to warnings given by the teacher to students in any form;
    • A written warning made in a standard format in the form of a letter and addressed to students who commit violations as referred to in Point 5 and Point 6 of these Terms and Conditions;
    • Teachers and Cakap Representatives are able and/or allowed to suspend accounts if the verbal and written warnings are not heeded and/or ignored by the student concerned;
    • Teachers and Cakap Representatives are able and/or allowed to take legal remedies if the student concerned still commits Violations as referred to in Point 5 and Point 6 of these Terms and Conditions;

  8. Cakap users are expected to learn from our system and are not expected to reach our representatives (Teachers, Support, and Sales) outside the Cakap platform.
  9. In Club class, users are expected to have a valid and non-offensive username to have better collaborative learning with other group members.

By visiting or using our Site, you agree that these Terms and Conditions are governed by and will be construed in accordance with the laws in Indonesia. The courts of Indonesia have exclusive jurisdiction over any disputes between you and us, regardless of whether you are a registered user/customer and regardless of the type of dispute. You agree not to initiate or prosecute any action against us other than in the Indonesian courts and you hereby consent to, and waive all defenses for the lack of personal jurisdiction and non-convenience forum with respect to, the venue and jurisdiction of the Indonesian courts. Notwithstanding this, you agree that we will still be permitted to apply for punitive remedies (or an equivalent type of waiver) in any jurisdiction. Cakap makes efforts to ensure that its publications, advertisements and offerings on this site fully comply with the requirements of Indonesian Law where it is intended for the content to be viewable. These Terms and Conditions constitute the entire agreement between you and Cakap. Cakap reserves the right to enforce this agreement on its own behalf and on behalf of and for the benefit of its affiliated entities. Apart from which affiliated entities are entitled to enforce the terms of this agreement in the same way as Cakap, no one in this agreement will confer any rights or benefits to third parties under the provisions of the Contracts (Rights of Third Parties) Act 1999.

Suspension and Termination Cakap may immediately suspend or terminate your access to our sites and applications without notice if there is a violation of these Terms and Conditions of use as determined above by you and it has come to our attention.

If you violate these applicable Terms and Conditions, we will seek deliberation approaches to reach consensus. However, if these efforts are not successful, then we will take firm action and if necessary we will seek a legal settlement regarding the violations committed by Cakap users.

Your registration may be terminated and your profile and any content or information that you have posted on this site or application may be deleted at any time. We may prohibit you from using or accessing these sites and applications for any reason, at any time in our sole discretion, with or without notice. These Terms and Conditions shall apply to any use of this site and application, also after your registration was terminated.

In providing a hardcopy certificate, Cakap user will be charged an additional fee of IDR 200,000.

Cakap reserves the right to change the agreement without prior notice.

  4. The user is willing to prepare his or her personal image for documentation and certification purposes. Cakap does not have the right to distribute images without the user’s permission.
  5. Minimum age 4 (four) years to be able to take Private classes, Semi-Private and Corporate classes.
  6. Minimum age of 16 (sixteen) years to be able to take Club classes.

  1. Registration can be done by filling out a form on the cakap.com page or in our application. Registration can be done independently or by contacting our Study Advisor who will assist with the registration process.
  2. When you apply for the course, you will also be required to upload certain information, such as name, address, date of birth, profile picture, phone number, verify email, gender, occupation and course purchase needs in Cakap. Any member wishing to apply for one of the courses must meet these requirements and provide correct information that can be supported by legal documents.
  3. The user is responsible for protecting the user’s credentials. The User agrees that it will not disclose the user’s personal credentials to any third party and that the user will be solely responsible for any activities or actions under the user’s Cakap Account, regardless of whether the user has authorized such activity/action or not. Users should immediately inform Cakap about unauthorized use of the user’s Cakap Account.

  1. Users will start subscribing for a maximum of 1×24 hours after making payment. Users can delay the activation of the study package for up to 30 days from the payment agreement.
  2. Cakap only sends invoices through [email protected], Cakap is not responsible for any form of fraud for invoices sent from accounts other than [email protected]. Study Advisor Cakap will also help send payment invoices when explaining payment procedures, as well as during the process of reminding payments for users who have not made payments.
  3. Packages that have been purchased cannot be refunded either in the form of money and/or transferred to another account.
  4. When Study Advisor Cakap contacts prospective users, all phone conversations will be recorded for convenience when transacting.

    1. The total active days in Cakap will be different each month. Users will be notified of the holiday through the website page or by email.
    2. Holidays for Mandarin classes based on Chinese and Indonesian calendars.
    3. Holidays for English and English classes for Children based on the Philippine calendar.
    4. Holidays for Japanese classes based on the Indonesian calendar.
    5. Holidays for Indonesian classes based on the Indonesian calendar.
    6. Holidays for Korean classes based on the Indonesian calendar.
  1. Learning package with credit sessions, is a study program that is divided into 3 categories:
    • Private Classes that free the User to determine how many study sessions will be taken according to the study package period owned with a minimum of 1 session in 1 day.
    • Semi-Private classes are granted access to 3 sessions in 1 week with periods corresponding to the package purchased or selected (3 months and 6 months period).
    • Corporate Classes are given access to study in the form of credit sessions in accordance with the number of sessions and study schedules agreed by the Corporation with Cakap.
  2. Learning package with periodic meeting sessions, is a package that only applies to Private classes where this package is divided into 3 types:
      • Brush Up: A 3-month (90-day), 6-month (180-day) or 12-month (360-day) study program that has 1 (one) maximum booking session per day. If the user does not attend the class the previous day, then it cannot be accumulated the next day.
      • Skill Building: A 3-month (90-day), 6-month (180-day) or 12-month (360-day) study program that has 2 (two) maximum booking sessions per day. If the user does not attend the class the previous day, then it cannot be accumulated the next day.
      • Intensive: A 3-month (90-day), 6-month (180-day) or 12-month (360-day) study program that has 3 (three) maximum booking sessions per day. If the user does not attend the class the previous day, then it cannot be accumulated the next day.
  3. Users are advised to take lessons daily for Unlimited Plans and at least 3 to 4 times within a week for Packages with credit sessions.
  4. For Private classes, The Terms and/or mechanisms for class bookings, cancellations, and schedule changes are made independently by the user through the Cakap dashboard.
  5. Users can have 2 (two) Private Cakap learning packages on the same language option in 1 account. In this case, the following provisions are applied:
    • The package that will be active first is the package that is first paid;
    • The second package will be active after the active period of the First Plan has ended (for unlimited plans) and/or after the credit session runs out (for packages with credit sessions).
  6. Private Class, Semi-Private and Corporate classes start from 08:00 WIB and end at 21:00 WIB. Cakap will ensure the availability of teachers in accordance with the needs of Cakap users.
  7. Club Class starts from 08:00 WIB to 21:00 WIB. Users can take any classes that are running.
  8. To maintain the quality of teaching in Cakap, some lessons will be recorded and stored on Cakap’s servers. The recording became fully the Right of The Cakap.

Placement Test

  1. User level placement tests are conducted individually for all Users of the Semi-Private class using a personal account.
  2. The results of the level placement test will be informed to the User by email.
  3. If the results have not been received within 1ร—24 hours, the User can contact the Study Advisor Team.

Formation of class groups

  1. Before classes begin, the formation of classes will be assisted by the Study Advisor Team. The class formation waiting period will be carried out no later than two weeks after the User makes payment.
  2. Classes will start two weeks from the time the User makes the payment or the User can start the class immediately if the User invites 1 – 2 other students to complete the formation of the group.
  3. The ideal group formation if all Users in one group have the same level as evidenced by the results of the User level placement test organized by Cakap.
  4. If the establishment of the ideal group referred to in point 3 above is not achieved, and/or if there is a special request from the User to be combined into one group with another User who is at a different Level, then the Study Advisor team will form a mixed group.
  5. If there is a level difference between Users and other Users in 1 group, then the Education Team will determine the appropriate and appropriate level for the group.
  6. The study advisor team will request a letter of approval from the Users to express the user’s consent to all matters relating to the determination of the class level.
  7. Once the group is formed and the teaching-learning program is already running, the User is not allowed to change group members or move to another group. Specifically for the formation of semi-private kids group, there are additional criteria based on the age of the user to maximize the learning process in Cakap with the following divisions:
    • Age 4 (Four) to 6 (Six) years.
    • Age 7 (Seven) to 11 (Eleven) years
    • Age 12 (Twelve) to 15 (Fifteen) years.

Class bookings, schedule change, class cancellations and Leave

    1. Once the group is formed, the Student Success Team will help the User book classes during the program in accordance with the days and hours agreed by all Users in one group.
    2. Users are not allowed to make their own reservations without the knowledge of the Student Success Team and/or other Users in one group.
    3. To change the study schedule and cancel classes, the User can inform the Student Success Team through the Whatsapp group that has been provided after it has been agreed by all Users in one group no later than 24 (twenty-four) hours before the class starts.
    4. Requests for replacement and cancellation of the study schedule must be submitted no later than 24 (twenty-four) hours before the class takes place.
    5. Users who have purchased study packages, but for holiday reasons, prolonged illness or other reasons that result in users not being able to follow the learning process in Cakap can apply for study leave. Semi-Private and Corporate classes, leave applies to all users in one group and has obtained mutual consent. The application of study leave must be notified to Student Support & Success Cakap no later than 3 (three) business days in advance.

Technical Constraints, Delays and Absence of Users

  1. There will be no additional time and there will be no replacement classes if the User experiences technical difficulties, delays, and/or absences.
  2. Teachers will wait for a maximum user attendance of 30 (thirty) minutes in the class. If it exceeds that time, the class will be ended and completed and the User is deemed not to have attended the class.
  3. If there are technical constraints related to the learning platform used, the User must inform the Student Success Team for a maximum of 1 (one) week from the time the technical constraint occurs.
  4. If technical constraints persist for 3 (three) times after the standard technical resolution is made (moving to a backup platform), then the Student Success Team will conduct a technical meeting to accommodate additional learning platforms specific to the group.
  5. Once the new platform is approved by all Users in one group, no further changes will be made until the package is complete.

Technical Constraints, Delays and Teacher Absences

    1. If there are technical constraints on the Part of the Teacher while the class session is running (before the 15th minute for private classes and before the 25th minute for semi-private classes), then the class will be canceled and Cakap will replace the period / credit according to the number of classes affected. Cakap ensures that this replacement will remain worth the initial package. If the User/ the Users agrees to continue the class, then there will be no additional duration / extension period / credit.
    2. If within 5-10 minutes of the class start the teacher has not been present in the class, immediately contact Cakap Student Success via whatsapp at the following link https://bit.ly/Cakapsupport or via live chat on cakap website.
    3. If the Teacher is late to the class up to 10 minutes, then the Teacher is obliged to add the duration left to 50 minutes for semi-private classes. Examples of delayed times:
      • 0-5 minutes: The teacher will add the duration according to the delay of 0-5 minutes
      • 6-10 minutes: The teacher will add the duration according to the delay of 6-10 minutes
    4. If the Teacher is late to the class after the class runs more than 10 (ten) minutes, then the User can choose the class canceled or the class resumed.
    5. If all Users agree to cancel classes, Cakap will replace the period/credit in accordance with the number of classes affected and Cakap will ensure that the replacement will remain worth the initial package
    6. If all Users agree to continue the remaining class time, then there is no increase in duration and change of period / credit.
    7. Users are allowed to rebook classes on the same day if agreed upon by the User in one group, with the applicable provisions that are no later than 6 (six) hours before the class schedule starts.
    8. No more Teachers providing additional class sessions outside of schedules and platforms, and no additional study time in the next class.

Final Test and level completion certificate

  1. The Education Team will prepare and give the final exam in the form of a speaking test. This becomes part of the standard operating procedures imposed by Cakap as a mechanism and/or semi-private class completion procedure.
  2. For Users who have not achieved the minimum completion of learning and/or the last material, The Cakap Party will offer the User to perform a Semi-Private Class Extension.
  3. The User is entitled to a Certificate of Attendance (CoA) after the User completes all sessions with the minimum requirement that the User has completed 30 (thirty) hours of study sessions. This CoA provision does not apply to Users who do not meet the minimum standards set out above.
  4. The User is entitled to a Certificate of Completion (CoC) after the User completes all sessions as well as taking the final exam in the form of a speaking test in accordance with the mechanism and/or Exam Procedure specified by the Cakap Party.
  5. Reports to Users are limited to attendance status and daily progress reports.

Consultation Sessions (Semi-Private Kids Group Only)

  1. After completing a minimum of 20 (twenty) hours of study sessions, the User’s parents may be scheduled to hold consultation sessions with individual Proficient Teachers (not groups). This session is held for parents of students who want to know the development of learning the child.
  2. To schedule a consultation session, the student’s parents can communicate this to the Student Success Team through the WhatsApp group that has been provided.
  3. Consultation sessions are scheduled 1 (one) week after the request is received by the Student Success team.
  4. One consultation session will be attended by the parents of the User, one Teacher, and 1 representative from the Education Cakap Team.

Study Group Extension

  1. Renewal for Semi-Private classes will apply if all Users in one group agree to their session to be extended.
  2. If the request for Semi-Private Class Extension as mentioned above is requested only by one User and not followed by another User, then in this case the Cakap Party will provide several Options that can be taken by the User, including:
    • Users will be offered by Cakap parties to switch to Private classes
    • Users will be advised by Cakap Parties to be able to search for other Users of the same level.
  3. Groups that some users do not renew are allowed to search for replacement users.
  4. Replacement users are required to meet the requirements in taking the final test and level completion certificate.
  1. Mandarin, Mandarin For Children, Japanese, Korean and Indonesian Private Classes will be 45 (forty-five) minutes long. While the study time for the English Private Cakap class, English for Children is 25 (twenty-five) minutes.
  2. The Cakap Club class will be 25 (twenty-five) minutes for the trial class and 50 (fifty) minutes for the premium class. There is no minimum time limit to be able to attend Club classes but users are advised to be able to take club classes in full for the learning materials to be fully accepted.
  3. Private Cakap class users who are not present for a maximum of 15 minutes after the class starts will be deemed absent.
  4. Delays in entering the class when the class has begun will reduce the duration of the predetermined learning process (in point 1 and 2).
  5. Our teachers give a maximum tolerance of 5 (five) minutes (for Private classes) from the time of booking so that you can still enjoy the maximum duration of study.
  6. In Private Cakap classes, our teachers will wait up to 15 (fifteen) minutes late from the booking time so that users can enjoy the rest of the class duration.
  7. Club class only, there is no minimum time limit to be able to attend the class.
  8. Users will be considered to be present if they have attended a class of at least 10 (ten) minutes for a Private Cakap class.
  1. Once the User has completed certain criteria for level completion (including but not limited to completed teaching hours, materials, exams, and improvements in their speaking skills) Users will be awarded an increase in their level and a certificate for completion of a certain level.
  2. The level of progress and certification of Users in Cakap is fully The Right of Cakap as a learning institution and is granted on a discretionary basis by the head teacher / course manager in accordance with internal academic standards.
  1. You are required to take and complete the mid-exam and the final exam to get to the next level.
  2. Cakap friends who have not completed the mid-exam or final exam, cannot book classes or move up to the next level.
  3. The mid-examination takes place every mid-material in 1 (one) semester. Meanwhile, the final exam takes place at the end of the semester.
  4. You have one chance to repeat the exam if you fail to complete the final exam within 1 (one) week after the exam.
  1. In Private classes, users can select teachers available at the desired hours and book classes independently based on the calendar on the dashboard. If the user has difficulty choosing a teacher, the user can contact our Student Support & Success to help find the available teacher suitable for the user.
  2. In the Semi-Private and Corporate classes, teacher selection and class reservations are carried out by Cakap per the schedule agreement determined at the beginning of the period.
  3. If the selected teacher cannot teach according to the schedule the user has ordered, Cakap will provide a substitute teacher according to the schedule the user has booked.
  4. If the user disagrees with the substitute teacher provided by Cakap, then the user can cancel the class through the Student Success team. Cakap will provide compensation according to the terms of the applicable user package as follows:
    • Cakap Private Unlimited: an additional study period package.
    • Cakap Private Credit Based study package: a credit replacement for the study package according to the number of days or canceled classes.
  5. After successful cancellation, users can re-order classes by selecting a teacher and study time that is still available.
  1. Users who do not attend the class booked as stipulated in “Learning Duration and Attendance” point 8, will be considered absent and there will be no substitute class.
  2. In the event that the user does not attend the Semi Private and Corporate classes, the course will be continued according to the schedule and materials, and the lessons that have been completed are the full responsibility of the user.
  3. In private classes, users must book a class with a teacher at least 6 (six) hours before the desired class schedule and users are allowed to apply for classes at least 3 (three) hours before the class starts.
  4. In the Corporate class, class reservations are made by Cakap according to an agreed schedule and the user allows classes at least 24 hours before the class starts.
  5. The number of classes on the Unlimited learning package has no limit and does not have a maximum number. Meanwhile, for packages with credit sessions, the number of studies is a collection of the total credits held by the user.
  6. For Packages with credit sessions, if the person concerned has used all the class limit users as set out in point 5, the user can still speed up the class but the canceled credit will not be returned to the user’s account.
  7. Users who have purchased a package but due to vacation, prolonged or other reasons that prevent the user from participating in the learning process at Cakap can apply for study leave. The application of study leave must be notified to our Student Support & Success no later than 3 (three) working days in advance.
  8. Users can apply for leave a maximum of 2 (two) times in every 1 active and valid package with the same conditions and / or mechanism for the next package.
  9. Users can temporarily deactivate their accounts and/or take time off by paying IDR 200,000/leave time for 30 days. Regarding this, Users can contact our Student Support & Success to temporarily deactivate their Cakap User account.
  10. Investigation and adjustment of the study period will wait for users of payment proof services to the Support & Success team.
  11. The package will be activated automatically after the leave package ends and the user can make another class order. Regarding this, the user can contact Student Support & Success if the user has questions or experiences problems.
  1. If there is a network or hardware problem from the teacher, Cakap users need to report the problem to our Student Support & Success within 3 (three) days after the class is held by attaching a screenshot of the problem and a screenshot of the network speed test.
  2. If there are obstacles and / or obstacles while the class is running (before the 15th minute for Private class), then the class will be canceled and Cakap will replace the period/credit according to the number of affected classes. Cakap ensures that this replacement will still be worth the original package. If the User agrees to continue the class, there will be no additional duration/period extension/credits.
  3. Class rescheduling is done by deleting previously booked classes and an additional study period for the Unlimited study package or credits will be added by adjusting the number of canceled classes. This will not reduce the number of sessions the user has.
  4. If a network or hardware problem occurs from the user’s side during the class, the class will not be replaced and the User agrees to release Cakap from any liability in any form.

The user agrees not to, directly or indirectly, divulge and/or use any student’s Confidential Information with the Company (as long as the information is confidential) without Cakap’s prior written consent.

    1. Users are not allowed to have activities outside class time with teachers outside the Cakap platform. Cakap is not responsible for all forms of violations committed by Cakap Persons if an activity occurs outside the Cakap Platform.

    2. Users are not allowed to transfer the rest of the lessons to other users or other parties, including but not limited to the User’s family.

    3. Each user is only allowed to register 1 (one) account on the Cakap platform. Only registered users are allowed to enjoy the benefits of studying at Cakap. Cakap prohibits the use of 1 (one) account that is used by and/or for several Users. In the event of the use of an account by and/or for several users as referred to above, Cakap has the right to block the account.

    4. Buddy Cakap is expected to be able to provide polite, clear, and appropriate responses to the discussion topics given during the teaching and learning process. All messages that offend ethnic, religious, racial and other groups of people; contains abusive and hateful speech, sexual inclinations, and regional jargon or dialect is prohibited;

    5. Teachers and Cakap Representatives can and/or are allowed to take firm action when Buddy Cakap gives inappropriate behavior or some uncomfortable actions that can make the class uncomfortable.

    6. Teachers and Cakap Representatives can and/or are allowed to take firm action and if necessary take legal steps against all forms of Acts and/or Words and/or Statements that contain contents of violations of decency, Moral norms, Ethics applicable in Indonesia and distributed directly or indirectly either through electronic media and/or social media in any form whose implementation mechanism and the application of sanctions are subject to the provisions of the legislation in force in Indonesia;

    7. Regarding the provisions as referred to in Point 5 and Point 6 of these Terms and Conditions, Cakap Teachers and Representatives may provide firm action and/or sanctions in the form of:
      • Warnings are verbal including but not limited to Warnings given by the Teacher to Users in any form;
      • A written warning made in a standard format in the form of a letter and addressed to the User who violates the terms referred to in Point 5 and Point 6 of these Terms and Conditions;
      • Teachers and Cakap Representatives can and/or are allowed to suspend Accounts if the oral and written warnings are not heeded and/or ignored by the User concerned;
      • Teachers and Cakap Representatives may and/or are allowed to take legal remedies if the User concerned is still committing Violations as referred to in Point 5 and Point 6 of these Terms and Conditions;
    8. Buddy Cakap is expected to learn from our system and is not expected to reach our Cakap representatives (Teachers, Support, and Sales) outside the Cakap platform.
    9. In Club class, Buddy Cakap is expected to have a valid and non-offensive username to have better collaborative learning with other group members.

By visiting or using this Site, you agree that these Terms and Conditions are governed by and/or will be construed in accordance with Indonesian law. The Indonesian courts have exclusive jurisdiction over disputes between you and Cakap, regardless of whether you are a registered user/customer and regardless of the type of dispute, you agree not to enter into, initiate and/or demand any action against us other than in the Indonesian courts and you hereby agrees to, and disclaims all defenses for the lack of personal jurisdiction and forum non-convenience with respect to, the venue and jurisdiction of the Indonesian courts. Notwithstanding this, you agree that we will still be permitted to apply for punitive remedies (or an equivalent type of waiver) in any jurisdiction. Cakap makes efforts to ensure that its publications, advertisements and offerings on this site fully comply with the requirements of Indonesian Law where it is intended for the content to be viewable. These Terms and Conditions constitute the entire agreement between you and Cakap. Cakap reserves the right to enforce this agreement on its own behalf and on behalf of and for the benefit of its affiliated entities. Apart from which affiliated entities are entitled to enforce the terms of this agreement in the same way as Cakap, nothing in this agreement will confer any rights or benefits to third parties under the provisions of the Contracts (Rights of Third Parties) Act 1999.

Thus these Terms and Conditions are made in Indonesian and English, if there is a difference in interpretation between the two language versions, the Indonesian language will prevail.

Cakap may immediately suspend and/or terminate your access to our site and application without notice if there is a violation of these Terms and Conditions of use as determined above by you and it has come to our attention.

If you violate these applicable Terms and Conditions, we will seek deliberation approaches to reach consensus. However, if these efforts are not successful, we will take firm action and if necessary we will seek a legal settlement regarding the violations committed by Cakap.

Your registration may be terminated and your profile and any content or information that you have posted on this site or application may be deleted at any time. We may prohibit you from using or accessing these sites and applications for any reason, at any time in our sole discretion, with or without notice. These Terms and Conditions will apply to any use of this site and application, also after your registration is terminated.

In providing hardcopy certificates, Cakap users will be charged an additional fee of IDR 200,000 (two hundred thousand rupiah) per certificate.

Cakap reserves the right to change this agreement without prior notice.

  1. PT. Cerdas Digital Nusantara, also known as “Cakap” is an Indonesian-based technology-driven company specializing in the development of educational and skill development applications focused on online interactive learning.
  2. The Cakap website is located at https://cakap.com/.
  3. Terms & Conditions refer to an agreement between the User and Cakap that contains a set of rules governing the rights, obligations, responsibilities of the users and Cakap, as well as the procedures for using Cakap’s service system.
  4. Users are individuals who utilize Cakap’s services, including but not limited to participants, teachers, and other parties who visit the Cakap website.
  5. Teachers are registered Users who provide lessons to Users and/or participants on the Cakap website.

Registration

  1. Users are required to use their real names corresponding to valid identification data such as ID cards or Student Cards.
  2. Cakap, without obligation, reserves the authority to take necessary actions against any alleged violation or breach of the Terms & Conditions and/or applicable laws by Users, including freezing or deleting User accounts, without prior notice.
  3. Users agree not to use, modify, alter, decompile, duplicate, resell, and/or exploit in any manner the software or hardware systems, networks, and/or data of the Cakap system using automated or manual technologies without permission from Cakap.
  4. Users agree not to access or use the Cakap website directly or indirectly, wholly or partially, with viruses, software, or other technologies that may potentially weaken, damage, disrupt, hamper, restrict, and/or compromise the functionality and integrity of the software or hardware systems, networks, and/or data on the Cakap website/application.
  5. Users are prohibited from creating and/or using hardware/software/features and/or other tools, including but not limited to emulators, robots, macros, crawlers, and/or automated devices, intended to access or use Cakap’s services, such as (i) creating multiple accounts; (ii) manipulating devices to harm Cakap; (iii) web scraping or content copying; (iv) engaging in spamming, sending massive electronic communications, chain letters; and/or (v) any other activities reasonably deemed as service and system manipulation.
  6. Users have the right to change their account name and account data according to Cakap’s policy. Users must ensure that any changes to the account name align with valid identification data such as ID cards or Student Cards since the Cakap account name affects the name displayed on Cakap certificates. Users are personally responsible for any changes made to the account name.
  7. Users are personally responsible for maintaining the confidentiality of their account and password for all activities carried out within their account.
  8. Cakap will never ask for a user’s username or password for any reason. Therefore, Users are urged not to provide such data or any other sensitive information to parties claiming to be Cakap or any other unsecured entities.
  9. Users agree to log out of their account at the end of each session and to inform Cakap of any unauthorized use of their password or account.
  10. Users understand and agree that any leakage of User data resulting from User negligence, including but not limited to approving and/or granting access to account information sent by Cakap through notification messages to third parties via the User’s device, lending the account to others, accessing links provided by others, providing or showing passwords or emails to others, or any other User negligence that leads to loss or obstacles on the User’s account, is not Cakap’s responsibility. Thus, Users release Cakap from any claims, demands, and/or damages of any kind against Cakap.
  11. Confidential Information refers to any data and/or information in any form that belongs to each PARTY (both Users and Cakap) disclosed to the other PARTY and is generally not known to the public (“Confidential Information”), whether tangible or intangible, disclosed at any time and in any manner, including but not limited to:
    • Any business and marketing strategy, financial information, or projections, operations, sales estimates, plans and business models, and systems related to Cakap’s business and performance results related to activities in the past, present, or future of the party, its affiliates, subsidiaries, and affiliated companies;
    • Plans for products or services, databases, and lists of customers/learners/prospective learners, clients, or suppliers;
    • Any scientific or technical information, curricula and syllabuses, inventions, processes, procedures, formulas, improvements, technology, or methods;
    • Any concepts, reports, data, knowledge, ongoing work, images, designs, development tools, specifications, computer software, source code, object code, algorithms, flow charts, databases, discoveries, trade secrets, information, and trade secrets;
    • Any copyrights, trademarks, logos, service marks, trade names, domain names, literary works, audiovisual works, including any other intellectual property rights arising under the applicable law of the Republic of Indonesia or any country, owned, controlled, stored, held for use, used, or developed by and/or for Cakap;
    • Any form of screenshots, images, videos, and efforts in any form that can be categorized as dissemination, misuse, or deviations carried out by Learners/Users/families/affiliates;
    • Any other information reasonably deemed as the disclosing party’s Confidential Information.
  12. Users hereby agree to maintain the confidentiality of Cakap’s Confidential Information from other parties and will not use the Confidential Information for any purpose other than for the purpose of using the Cakap website for learning.

Payment

  1. Users are obliged to conduct transactions through the designated and provided transaction procedures by Cakap. Users make payments using the payment methods previously chosen.
  2. Users fully understand and agree that any transactions conducted through methods and/or transaction procedures specified and provided by Cakap and/or without Cakap’s knowledge (via private facilities/networks, messaging, special transaction arrangements outside the Cakap website, or other attempts) are the personal responsibility of the User. Cakap is not responsible for any losses arising from transactions conducted by Users outside the designated and provided transaction procedures by Cakap.
  3. Users understand and agree that delays in the payment process and additional costs due to differences between the User’s bank and Cakap’s official account bank are not the responsibility of Cakap.
  4. The activation of packages after purchase should occur within a maximum of 30 (thirty) days from the date of payment.

Payment Methods

  1. Users can make payments using the available payment methods, including but not limited to:
    • Virtual Account (BCA, BNI, Permata, Other Banks)
    • E-wallet (Gopay, Ovo, ShopeePay)
    • Credit Card
  2. Cakap is not responsible for payments made by Users using methods not mentioned in point 1 above.

Requirements for Joining Classes

  1. Users should have a basic understanding of operating Windows, Mac, Android, or iOS systems.
  2. Users should have a personal computer or smartphone; a recommended laptop or Android/iOS phone.
  3. Users should have a minimum internet connection of 5 Mbps to support learning activities.
  4. Users agree to prepare their personal images for documentation and certification purposes. Cakap will not distribute images without permission or approval from the User.
  5. Users must be at least 4 (four) years old to participate in Private, Semi-Private, and Corporate classes.
  6. Users must be at least 16 (sixteen) years old to participate in Club classes.

Participants

  1. Participants are expected to be present in the virtual classroom at least 3 (three) minutes before the class starts to avoid being late.
  2. Cakap and the Teacher cannot extend the learning time if there is a delay caused by the participants. However, Cakap will compensate or add learning time if there is a delay caused by the Teacher.
  3. If a participant is absent, the class will proceed as scheduled, and the absent participant will be marked as ‘absent’ on the Progress Report.
  4. If any other individual enters the virtual classroom during the teaching and learning process but is not a pre-registered participant, Cakap will ask that individual to leave the class or remove them from the class.

Connection Test

  1. At least 15 (fifteen) minutes before the class starts, participants are advised to perform a connection test with the Student Success (Customer Service) team at Cakap.
  2. Cakap will not extend the learning time if there is a connection problem from the participant’s end during the class. However, if the connection problem arises from the Teacher’s end, additional learning time will be provided for the participants.

Private Class

  1. The schedule for booking classes each week will open every Friday. Participants are encouraged to book classes for the following week to allow better preparation for both participants and teachers.
  2. The process of booking private classes can be done at least 3 hours before the class starts.
  3. The process of canceling a private class can be done at least 3 hours before the class starts. Classes not canceled within this time frame will be counted as missed classes, and the credit session will not be refunded.

Group Class

  1. he process of canceling a group class can be done at least 24 (twenty-four) hours before the class starts by contacting the Student Success team at Cakap for assistance with the cancellation process. Classes not canceled within this time frame will be counted as missed classes, and the credit session will not be refunded to the participant.
  2. The calculation of the active duration for Group Classes begins from the start of the first class and ends on the same date as the contract duration.
  3. The company has the opportunity to change the class schedule up to 10% of each session provided.

Learning Material

  1. The provision of e-learning materials is the responsibility of Cakap according to the package ordered by the participant or the company user, provided that the curriculum is available.
  2. For e-learning materials that require development and adjustment based on specific requests from the company user, a curriculum development fee will be charged outside of the class fee.
  3. Requests for material customization can only be accommodated before the learning program and/or training begins. If there is a request for customization after the program starts, Cakap reserves the right to refuse the request, and the implementation may be considered for the next program based on mutual agreement.

Class Booking Process

  1. Users can choose an available Teacher at the desired time and book classes independently based on the calendar provided on the User’s dashboard.
  2. Class bookings are done independently by the User based on their learning package.
  3. Class bookings should be made at least 3 (three) hours before the selected class starts. Participants who make extendable class bookings will use 2 (two) credits for the booking.
  4. Group Class bookings will be done by the Cakap team according to the schedule agreed upon by the User and the Cakap team.
  5. Users can reschedule a booked class by canceling the class at least 3 (three) hours before the class starts and then rebooking the class 3 (three) hours before the selected class starts.
  6. For extendable class bookings, both sessions will be canceled automatically by the system, reducing the number of class cancellation limits by 2 (two) credits.

Student Support Operating Hours

Cakap’s operational hours are from Monday to Sunday, starting at 08:00 – 22:00 WIB (“Operating Hours”).

Duration & Attendance of Learning

  1. Users who do not attend a booked class as regulated in the “Duration and Attendance of Learning” point 8 will be considered absent, and there will be no replacement class.
  2. In the event of non-attendance for Semi-private and Corporate classes, the course will continue as scheduled, and the missed lessons will be the sole responsibility of the User.
  3. Users canceling a class for credit session learning packages (Mini and Maxi) will have half of the total credits from the purchased Mini and Maxi package deducted.
  4. For Users with credit session learning packages (Mini and Maxi), if all class cancellation limits as regulated in point 3 have been used, Users can still cancel classes, but the canceled credits will not be refunded to the User’s account.
  5. Users who have purchased a package but are unable to attend the learning process at Cakap due to reasons such as vacations, prolonged illness, or other reasons can apply for a learning leave according to the number of leave opportunities in the package owned by the User, as regulated in point 6. Applications for learning leave must be submitted to our Student Support & Success team at Cakap no later than 3 (three) working days in advance.
  6. Users with Cakap Private and Semi-private learning packages are entitled to learning leave with the following provisions:
    • Cakap Private and Cakap Semi Private 6 (six) months will be granted 1 (one) leave opportunity once every 1 (one) period of their active package.
  7. Users can temporarily deactivate their account by taking leave with an administration fee of Rp 200,000 (two hundred thousand Rupiah) / leave period for 30 (thirty) days. In this regard, Users can contact Cakap’s Student Support & Success to temporarily deactivate the user account.
  8. Leave requests and adjustments to the study period will be processed after Users submit proof of payment for the leave package to Cakap’s Student Support & Success team.
  9. The original package will automatically become active after the leave package ends. Users can resume class bookings one day after the leave period ends. In this regard, Users can contact Cakap’s Student Support & Success if they have any questions or encounter any issues.
  10. Legal guardians of users who are under the age of 10 (ten) years are advised to participate and attend the user’s class, in order to offer supplementary guidance as provided by the instructor.

Obstacles or Disruptions

  1. If there is a network or hardware problem arising from the Teacher’s end, Users need to report the issue to Cakap’s Student Support & Success within 3 (three) days after the class is conducted, along with providing screenshots of the problem and network speed test.
  2. If there are obstacles and/or disruptions arising from the Teacher’s end during class (before the 15th (fifteenth) minute for Private classes), the class can be canceled, and Cakap will provide replacements or credit period equal to the number of affected classes. Cakap ensures that this replacement will remain equivalent to the original package. If Users agree to continue the class, no additional duration/extension of the period/credit will be provided.
  3. Replacement of study sessions by canceling previously booked classes by the User, and providing Makeup-Credit as a substitute for Daily 1x package users, by adjusting the number of canceled classes or refunding the previous credit for Private Mini and Private Maxi package users. This shall not diminish the number of sessions owned by the User.
  4. If network or hardware problems occur from the User’s end during class, the class cannot be replaced or exchanged, and the User hereby understands and agrees to release Cakap from any responsibility in any form.
  5. Dashboard issues or any problems from Cakap’s and/or the Teacher’s end will be replaced through the submission of the 2023 credit addition form.
  6. If the User cannot attend classes due to the following reasons:
    • Events in the category of Force majeure (landslides, floods, hurricanes, volcanic eruptions, epidemics, states of war, riots, rebellions, terrorism, sabotage, military coups, and others)
    • User’s illness
      • Cakap will provide compensation by replacing the learning sessions a maximum of 2 times.

Rescheduling, Cancellation of Semi-Private Classes

  1. After the group is formed, Cakap’s Student Success team will assist participants in booking classes during the program according to the agreed-upon days and times by all participants in one group.
  2. Users and/or participants are not allowed to make bookings independently without the knowledge of Cakap’s Student Success team and other Users and/or participants in one group.
  3. If Users want to reschedule their learning and cancel classes, Users must inform Cakap’s Student Success team through the provided WhatsApp group, agreed upon by all Users and/or participants in one group, no later than 24 (twenty-four) hours before the class starts.
  4. Rescheduling of classes shall be carried out by canceling previously booked classes and adding study periods for the learning package by adjusting the number of canceled classes or refunding the previous credit for the User and/or participants. This shall not diminish the number of sessions owned by the User and/or participants.
  5. If network or hardware problems occur from the User’s end during class, the class will not be replaced, and the User hereby understands and agrees to release Cakap from any responsibility in any form.
  6. Requests for rescheduling and canceling class schedules must be sent no later than 24 (twenty-four) hours before the class starts.

Course Replacement Policy

  1. User is permitted to request a course replacement subject to the following applicable conditions:
    • User may request a course replacement within the first 5 (five) sessions of the course.
    • In the event the User wishes to proceed with the course replacement, they will be directed to add additional sessions equal to the number of sessions already attended.

Change of Package from Regular to VIP

  1. In the event that a user wishes to submit a request for a change of package from regular to VIP, the submission may be made if the user is among the fortunate ones contacted by our team, and it should be done when there are still fewer than 5 (five) meeting sessions remaining.
  2. If a user wishes to submit a request for a change of package from regular to VIP, the submission may be made when there are still fewer than 5 (five) meeting sessions remaining, subject to an additional charge for the remaining sessions.

Extension of Period

  1. ย Should a user wish to apply for an extension of the period for a package that still has remaining learning sessions, a fee of Rp 200,000 for 1 (one) month will be imposed.
  2. With regards to the extension of the period, users are allowed to submit a maximum of 2 (two) extension requests.

Teacher Selection and Substitution

  1. In Semi-private and Corporate classes, the selection of Teachers and class bookings will be done by Cakap according to the agreed-upon schedule at the beginning of the period.
  2. If the selected Teacher is unable to teach according to the User’s booked schedule, Cakap will provide a replacement Teacher according to the User’s booked schedule.
  3. If Users do not agree with the replacement Teacher provided by Cakap, Users can cancel the class through Cakap’s Student Success team. Cakap will provide compensation according to the applicable User’s package as follows:
    • Cakap Private Daily 1x (once): an additional learning period
    • Cakap Private Mini and Private Maxi: credit replacement for the number of canceled days or classes.
    • After the successful cancellation:
      1. Cakap Private Daily 1x (once): Users can make new bookings on the following day. Users are not allowed to book classes on the same day. Cakap reserves the right to cancel the addition of a period if Users book classes on the same day.
      2. Cakap Private Mini and Private Maxi: Users can make new class bookings by selecting available Teachers and learning times on that day.

Level Advancement Examination

  1. Users are required to take and complete the level advancement examination to progress to the next level.
  2. Users who have not completed the level advancement examination cannot book classes or move on to the next level.
  3. Level advancement exams can be retaken if necessary, after obtaining approval from the head of the academic department in the respective course.

Extension of Learning Package Duration

  1. Users who extend the package for more than 1 (one) year from their last class will need to take the Placement Test again to align with the latest Cakap curriculum.
  2. Package extensions can be done through the Cakap application by selecting the learning package period according to the User’s needs.
  3. Before making payment, Users must ensure that the package extension is made using the registered email.

Leave Application

  1. Users who have purchased learning packages can apply for learning leave due to reasons such as vacations, prolonged illness, or other reasons that prevent Users from participating in the learning process at Cakap.
  2. Specifically for Semi-private and Corporate classes, the leave mentioned in point 1 above applies to all Users in one group who have obtained approval from all Users and/or participants in one group who have purchased learning packages for such leave.
  3. Specifically for Semi-private and Corporate classes, the leave mentioned in point 1 above applies to all Users in one group who have obtained approval from all members within the group.
  4. Users with Cakap Semi-private learning packages are entitled to learning leave with the following provisions:
    • Cakap Semi Private 6 (six) months will be granted 1 (one) leave opportunity once every 1 (one) period of their active package.
    • Cakap Semi Private 12 (twelve) months will be granted 3 (three) leave opportunities once every 1 (one) period of their active package.
    • Leave requests must be notified to Cakap’s Student Support & Success team no later than 3 (three) working days in advance.
    • Users taking leave will be charged an administration fee of Rp 200,000 (two hundred thousand Rupiah) / leave period for 30 (thirty) days of leave. In this regard, Users can contact Cakap’s Student Support & Success to temporarily deactivate the Cakap user account.
    • Leave requests and adjustments to the study period will be processed after Users submit proof of payment for the leave package to Cakap’s Student Support & Success team.

Level Development and Certification

User’s progress and certification at Cakap are entirely the right of Cakap as a learning institution and are provided based on the discretion of the head of the academic department in the respective course.

Report

Corporate Participants
The progress report of participants can be accessed directly by the participants or corporate users through their corporate accounts. Apart from accessing the dashboard account, the Cakap team will send reports to the Person in Charge or representative of the class, which consists of:

  1. Teacher’s comment
  2. Attendance report: The attendance record of class participants for one month.

Individual Participants

The progress report of participants can be accessed directly by the participants using their registered accounts and can be accessed on the student dashboard. The Cakap team will also send reports to the Person in Charge or representative of the class, which consists of:

Graduation & Certificates

  1. Cakap provides two types of certificates, namely the Certificate of Attendance (CoA) and the Certificate of Completion (CoC). The CoA or CoC will be automatically sent to the registered email of the user when they have completed the minimum number of learning hours.
  2. The name stated on the certificate cannot be changed. Users must ensure that the name registered on the Cakap account matches the name on their ID card (KTP) or, if the user does not have an ID card, they may use other official documents showing their identity.
  3. The user may opt to receive the Certificate of Completion in hardcopy, incurring an additional fee of Rp 200,000 (two hundred thousand Indonesian Rupiah) per certificate, inclusive of transportation costs.

  5. Minimum Requirements: completing the post-test exam and achieving a minimum 80% (eighty percent) attendance.
  6. Users who are considered graduates from Cakap will receive one of the two types of certificates below:
    • Certificate of Attendance: This certificate indicates the participant’s participation and will be given to participants who meet the minimum session requirement in each language.
    • Certificate of Completion: This certificate indicates that the participant has completed one language learning level and the final exam, after taking the final test at the end of the session.
  7. Certificates will be issued no later than 1 (one) month after the participant’s request in the form of an e-certificate.

Intellectual Property Rights of Cakap Materials:

  1. All materials, syllabi, content, and/or any information inherent and present on the Cakap platform that indicates ownership and/or identity of Cakap are intellectual property rights of Cakap.
  2. Users are expected to learn from our system within the usage permitted and provided by Cakap and are not allowed to reach out to Cakap representatives (including Teachers, Support, and Sales) outside of class hours and outside the Cakap platform.
  3. Cakap is not responsible for any violations committed by individuals claiming to represent Cakap if such activities occur outside the Cakap platform and outside the user’s class hours.
  4. Users are not allowed to transfer the remaining lessons to other users and/or parties, including but not limited to family members of the user.
  5. Each user is only allowed to register 1 (one) account on the Cakap platform. Only registered users are allowed to enjoy the learning benefits at Cakap. Cakap prohibits the use of 1 (one) account by and/or for multiple users. In the event of account usage by and/or for multiple users as referred to in this point, Cakap has the right to block such account.
  6. Users are expected to provide polite, clear, and relevant responses to the discussion topics during the teaching and learning process. All messages that offend ethnic groups, religions, races, and other groups; contain abusive and hateful language, sexual tendencies, and regional jargon or dialects are prohibited.
  7. Teachers and/or Cakap representatives may take firm actions when Users exhibit inappropriate behavior or any uncomfortable actions that disrupt the class environment.
  8. Teachers and/or Cakap representatives may take firm actions and, if necessary, take legal steps against any actions and/or statements containing violations of decency, moral norms, and ethics applicable in Indonesia, whether distributed directly or indirectly through electronic media and/or social media in any form. The implementation and application of sanctions are subject to the provisions of the prevailing laws and regulations in Indonesia.
  9. Regarding the provisions referred to in Point 5 and Point 6 of these Terms and Conditions, Teachers and/or Cakap representatives may take firm actions and/or sanctions, including but not limited to:
    • Oral warnings, including warnings given by Teachers and/or Cakap representatives to Users in any form;
    • Written warnings made in a standard format in the form of a letter and addressed to Users who violate the provisions mentioned in Point 5 and Point 6 of these Terms and Conditions;
    • Teachers and/or Cakap representatives may suspend the User’s account if oral and written warnings are not heeded and/or ignored by the relevant User;
    • Teachers and/or Cakap representatives may take legal actions if the User continues to commit violations as mentioned in Point 5 and Point 6 of these Terms and Conditions;
    • In group classes, Users are expected to have valid and non-offensive usernames to facilitate better collaborative learning with other group members.

  11. User is strictly prohibited from disseminating content or information related to our products or services unless they have obtained prior written consent from Cakap.
  1. Users agree that with respect to the costs of Products for which payment has been made, such payments are non-refundable. “Cakap” will not provide any refunds for said Products under any circumstances.
  2. Users agree that Products for which payment has been made cannot be exchanged for other products or services offered by “Cakap.”

Cakap may immediately suspend and/or terminate a user’s access to our website and application with notice if there is a violation of these Terms and Conditions by the user and such violation has come to our attention.

If a user violates these Terms and Conditions, we will attempt to resolve the matter through discussions to reach an agreement. However, if such efforts fail, we will take decisive action, and if necessary, we will pursue legal means to address the violations committed by the user.

User registrations may be terminated, and user profiles as well as any content or information posted by users on this website may be deleted at any time. We may prohibit a user from using or accessing this website for any reason, at any time, at our discretion, with notice. These Terms and Conditions will apply to any use of this website, even after a user’s registration is terminated.

Updates to Legal Choices

If Users use the features/services available on the Cakap Site/Application, Users hereby acknowledge understanding and agreeing to all terms and conditions specifically related to the feature/service being used.

Any matters not or not regulated in the specific terms and conditions of that feature will fully refer to the general Cakap terms and conditions.

By agreeing to Cakap’s Terms and Conditions, Users are also subject to Cakap’s Privacy Policy.

Terms & Conditions may be amended and/or updated from time to time without prior notice. Cakap suggests that Users carefully read and review this Terms & Conditions page from time to time to be aware of any changes. By continuing to access and use Cakap services, Users are deemed to agree to the changes in the Terms & Conditions.

Legal Choices

By visiting or using this Site, Users agree that these Terms and Conditions are governed by and/or will be interpreted in accordance with the laws of Indonesia. Indonesian courts have exclusive jurisdiction over disputes between Users and Cakap, regardless of whether the Users are registered users/customers and regardless of the type of dispute. Users agree not to bring, initiate, and/or pursue any action against Cakap other than in the Indonesian courts, and Users hereby agree and waive all defenses to lack of personal jurisdiction and forum non-conveniens with respect to the venue and jurisdiction of the Indonesian courts. Notwithstanding this, Users agree that Cakap will still be entitled to seek injunctive remedies (or an equivalent type of urgent legal relief) in any jurisdiction. Cakap makes an effort to ensure that the publications, advertisements, and offers on this site fully comply with the Indonesian laws, where such content is intended to be viewed. These Terms and Conditions constitute the entire agreement between Users and Cakap. Cakap has the right to enforce this agreement on its behalf and on behalf of its affiliates. Despite the fact that the affiliated entities have the right to enforce the terms of this agreement in the same way as Cakap, nothing in this agreement will confer any rights or benefits to third parties based on the provisions of the applicable regulations.
