Welcome to Cakap, a service-based website (“Service” or “Website”). (“Cakap”). We respect your privacy and want to know what information about you we collect and what we do with that information. Registration information. You are not required to register or provide any personal information about yourself to visit the website and or to see certain features available on our website in general. However, we may offer you the opportunity to register with us or “register for our mailing list”. Even though registration does not require visiting our website, to access premium features is available on our website and to use certain other services that can be offered on our website, you are required to register and create an account with Cakap (“Cakap Account”). When you create a Cakap Account, you are required to provide certain personal information. Including your first name and last name, username (will use your email address), your country of residence, telephone number and password. On the other hand, we may ask you to provide additional information such as your age, gender, other personal information about yourself to receive additional information about our services.

In addition, you may also be asked to provide credit card information and billing address before using the service. If you allow us to do so, we will store your credit card information in our database to facilitate the checkout process for the next transaction.

As part of the process of creating a Cakap account or for participating in certain promotions offered by Cakap such as entering sweepstakes, contests, surveys, newspapers, etc., in addition to names, e-mails and addresses, you may be asked to provide certain information by itself , does not personally identify you. In general, Cakap can use information about you in providing and improving services. Cakap can share this information with content providers on services, members and other organizations without non-personal forms to show general demographics and information choices among users of the Service or for other purposes. This information is included in the usage and demographic data, but is not included in personal information (such as your email address).

As part of the Service, Cakap responds to you regarding your development results in the form of video messages on third party sites, where messages can be seen by other users such as third party sites. Even though the video message will not mention your name or photo, if you do not wish to receive the response, you can sign out to receive the message from a third party site.

If you provide Cakap with correct personal information, we will take reasonable and appropriate steps to safeguard that information. Unless otherwise described in the Privacy Policy, Cakap will not notify, share, sell or rent personal information collected on our website to third party organizations for their sales or promotional purposes without your consent or except as part of a particular program where you can choose Exit. If you request to receive information from our members by selecting this option, we may share registration information and information regarding your transaction on our Services with our members. If you access the Service we use a co-branded version on our website that contains a message informing that it will be given to members whose company names are listed on co-branded sites, collected personal or non-personal information can be provided to members. Any use of such information by Cakap will be subject to a Privacy Policy and any use of that information by members will be subject to the Privacy Policy and privacy policies of the members. We will not provide your credit card account information to the Member’s Site or other third parties, other than the order process and credit card service provider permission as previously explained.

To safeguard your information about our services, we will send emails and notifications needed for administrative purposes on our Website and Services. We also provide users with the option to join the email delivery list to receive more information about our website, services, and offers. Also, we can allow you to choose whether you want to receive emails from third parties with whom our members are related. You can always change your choices by accessing your Cakap Account. Every marketing email from Cakap will have instructions on how to unsubscribe from our email delivery list.

We work with third parties that provide services, including website hosting, fulfillment of promotions, order processing, credit card licensing, data analysis and other administrative services. Personal information, including financial information, can be provided to third parties for the purpose of providing services to you. We ask to apply the responsibility for confidentiality to these service providers. We also reserve the right to share personal information with third parties where we believe that the law requires it, to implement the Terms of Service, to protect Cakap’s rights, ownership, safety or public security, to respond to emergencies, or other statements in the Privacy Policy.

We use proportional security methods to protect those on our servers. However, because there is no security system that can be penetrated, we cannot guarantee the security of our servers. This also allows the information you provide us to be tapped during transmission.

Whenever you provide sensitive information to Cakap (for example: credit card numbers), Cakap will take proportional measures commercially to protect that information in the form of a secure connection with your website browser. Cakap uses industry standard technology known as Secure Socket Layer (“SSL”) to protect the transmission of payment information to the website. You can check the security of your connection by looking at the address in your browser window. After you access the security of a server that is protected by SSL, the first character of the address will change from “http” to “https”.

To help protect your Cakap account information, please protect the security of your password. Your password will be maintained on our system in encrypted form because Cakap understands that privacy is important to you. Cakap will generate a new password if you forget and send it to the email account you provided. This will not affect your settings in any way. We encourage you to choose a password that is not clearly easy to understand by combining numbers and letters. Additionally, we recommend that you not share your password with anyone. Finally, you are responsible for maintaining the confidentiality of your password and all information regarding your Cakap account.

Remember to exit the Cakap account, and close your browser window whenever you leave your computer. This is to ensure other people cannot access your personal information, because your computer may be accessed by others or used in shared settings.

This Cakap Privacy Policy does not cover everything that is inherent in operating the internet, and because it is outside the supervision of Cakap, and is not implemented in a manner that is contrary to applicable law or government regulation.

Cakap holds the full right to keep, maintain and/or archiving authentic and/or original documents of this certificate in digital form. This is as set up on the https://cakap.com/verifikasi-sertifikat page. This certificate, in any format, whether digital or printed, is merely a representation and/or Copy of an authentic document recorded in the Cakap system and is valid only if all information therein corresponds to the document. All efforts and/or efforts relating to the alteration of information either in part or in whole may be subject to Legal Actions in accordance with the Laws and Regulations including but not limited to other derivative regulations applicable in the Republic of Indonesia.

If there are obstacles in terms of finding Certificate Number including but not limited to obstacles and / or other obstacles regarding the Issuance of Certificates, it can be communicated directly to our Customer Service.

You may delete your account at any time (including if you wish to withdraw your consent to your use of the services, we will have your information in accordance with applicable law). When you make a Request and/or Request to delete your account to our Customer Service, Deleting your account will result in the deletion of your account info and profile photo, and deleting your history of this account. Please understand that if you simply delete your account from your device without contacting [email protected], your information will be stored for a longer period of time. Please note that when you delete your account, this does not affect our status to the Cakap services you currently have.

You can delete your account from within the Cakap app. Deleting an account is a non-refundable process. We cannot cancel deletion, even if you perform this process by accident.

To delete a Cakap account:

Android/Website

  1. Call [email protected]
  2. Inform us of your intent, purpose and reasons to our Customer Service and submit a request to delete such capable account data. Our Customer Service are always ready to help you.
  3. Inform our Customer Service of the Phone Number, email address connected to your account, and other necessary information to allow our Customer Service team to delete your data.

iOS

  1. Go to Profile and click Settings.
  2. Click Delete Account at the bottom of the screen.
  3. Then, please fill in the reason as to why you are opting to delete your account.
  4. Verify your account by typing in your password (if you registered using your email) or log in again using your Google account, Facebook account, or Apple ID.
  5. You will then be directed to a screen where you need to reconfirm your decision to delete the account.
  6. If you decide to proceed with the deletion, check the toggle “Yes, I want to permanently delete my Cakap account and all its data.”
  7. Finally, click Delete Account Permanently.

Please note that, before deleting your account, you need to review the following.

  • You will no longer be able to log in to Cakap with this account.
  • Your personal information and settings will all be removed.
  • You will no longer have access to Cakap services such as Cakap Private, Cakap Club, Cakap Chat, Cakap Upskill, and other services.
  • Your class enrollment and package will all be canceled.
  • You will be unsubscribed from Cakap’s emailing list.
  • You will no longer have access to your study reports, materials, and certificates.
  • Deleting the parent’s account will automatically result in the deletion of the child’s information (Cakap Kids).

If you delete your account:

  • You cannot regain access to your account.
  • This process can take up to 5 [Five] working days from the start of the deletion process to delete all your account information. Copies of your information may also remain after 5 [Five] working days in the backup storage we use to recover in the event of a disaster event, software malfunction, or lost data. Your information cannot be accessed in a Cakap Account during that period.
  • We may store certain log data in our database even after you delete your account, but that data will not be associated with any identifying information so it can no longer be linked to your account. To do so, we regularly delete special identifying information from this log data, and replace each of your account IDs with replacement identifiers that cannot be linked back to your account after the account is deleted.
  • We may also retain your information for matters such as legal matters, violations of the provisions, or hazard prevention efforts.
  • Your personal information shared with Cakap including but not limited to other affiliated companies will also be deleted.

Consistent with the Children’s Online Privacy Protection Act 1998 (COPPA), we will never intentionally request personal information from anyone under the age of 13 without parental consent. Everyone who provides us with their personal information through the Service declares that they are 13 years or older.

Cakap allows other companies, to call third-party ad servers or ad networks, to serve advertisements in Services. Ad servers or ad networks use technology to send, directly to your browser, advertisements and links that appear in Services. They will automatically receive your IP address when that happens. And also allows them to use other technologies (such as cookies, JavaScript, or web beacons) to measure the effectiveness of their advertisements and to adjust their advertising content.

Cakap does not provide personal information on ad servers or ad networks to third parties without your consent or permission as part of a particular program where you can choose to enter. The personal information that may be collected by the third parties are:

A. Data Linked to You

The collected data is the ones linked to your identity, such as to your account, your device, or your details (for example, your phone number). 

B. Data Used to Track You

Refers to data from the app that is linked with your data collected from other companies’ apps, websites, or offline properties, and used for ads or shared with a data broker.

Please keep in mind that if advertisers ask Cakap to show advertisements to certain visitors or some visitors and you respond to these advertisements, advertisers or ad servers can decide that you match the criteria of the visitors they are looking for.

You must discuss each privacy policy of the third party ad server or ad network. Cakap’s Privacy Policy does not have that authority, and we cannot supervise all activities, such as advertisers or other websites.

Connecting to other sites is an integral part of internet functions, including our website. Each link that is linked to a page that displays a URL other than the domain name that ends at Cakap.com on the address window of your browser is a link to a site outside our service and beyond Cakap’s supervision. This includes links to our suppliers of content on services, affiliates and links to any other third parties that may be connected to Cakap. These other sites may send their own cookies to you, collect data or try to obtain personal information. Cakap cannot guarantee and this is not our responsibility for content outside the site.

Please note that whenever you provide personal information on other sites (for example via message or chat), that information can be collected and used by people you do not know. While Cakap seeks to protect the personal information and privacy of our visitors, we cannot guarantee the security and privacy of any information that you provide on other sites, and you do so at your own risk. Please learn about privacy and security practices and policies from outside the website before providing personal information to them.

This service is held in Asia. If you are a user accessing services from the European Union, the United States or various other countries with laws governing the collection of personal data, using and confidential notices, which are different from US law, please note that you transfer personal data to the United States that does not have the same data protection law as the European Union and other countries and by providing your personal data, you agree:

Cakap is responsible for protecting your personal information and will answer any questions regarding this Privacy Policy.

Face images collected are used exclusively to facilitate the face recognition process and identity recording for Third Parties. We do not use or share data for any other purposes without your consent, and we are not involved in selling face recognition data to third parties.

Security Measures:

We employ industry-standard security measures to protect the integrity and confidentiality of face recognition data during the recognition process in accordance with the applicable Personal Data Protection regulations in Indonesia, namely Law Number 27 of 2022. Our systems are designed to prevent unauthorized access, disclosure, alteration, and/or destruction of unauthorized data.

Third-Party Access:

We do not manage and share your face recognition data; any use of Face Recognition is only utilized by Third Parties after obtaining your prior consent, is necessary for one of the products by a third party approved by you, based on applicable legal orders, or required to comply with legal processes. We do not sell, rent, or exchange face recognition data.

Data Deletion:

We do not store copies of data; we only provide Third Parties with access to manage, ensuring your privacy is maintained through our systems.

Consent:

By using the face recognition services provided within the website and managed by Third Parties, you consent to the collection and processing of face images and/or recordings solely for face recognition purposes while using and interacting with the services we provide.

Children’s Privacy:

Our face recognition service is not intended for individuals under the age of 18. We do not knowingly collect or process face images of minors without explicit parental consent.

Data accessed from the camera will be strictly used for reporting to our customers and for improving the use of Cakap software. We may not be aware that information, data, or survey responses were obtained from users under the age of 18, except (i) where applicable local data protection laws establish a lower age limit; or (ii) we obtain necessary parental consent. If data collected from participants under the age of 18 does not meet any of the conditions in points (i) or (ii) above, we will promptly delete it.

Changes to the Privacy Policy:

We reserve the right to update or amend this Privacy Policy at any time. Any changes will take effect immediately upon the revised Privacy Policy being posted on our website. Please check this page regularly for updates.

By using our face recognition services, you acknowledge that you have read and understood this Privacy Policy and agree to the terms outlined herein.
